Policy and Regulations
Cancellation Policy Carefully review our cancellation policy before booking your service. The date and time is reserved for you once payment is made. All cancellations shall be made 45 days in advance of the service. After 45-days, there are no refunds. No exceptions. No-shows are also non-refundable. Cancellations made 45 days prior to your trip date will receive a full refund. Kapenas reserves the right to cancel your trip at any time, for any reason as there are circumstances out of our control (mechanical failures, serious crew illness, and weather). Upon the extremely rare instance that we cancel your trip, you will receive a full refund immediately. In such circumstances, Kapenas LLC is not responsible for any expenses incurred (such as airline tickets, car rentals, hotel reservations, and/or any miscellaneous travel expenses. Poor Weather WE DO NOT CANCEL or RESCHEDULE DUE TO RAIN (RAIN IS NOT CONSIDERED UNSAFE WEATHER)** Kapenas captains will determine if the conditions are safe to make way on the water. In South Florida, weather changes rapidly. Hazardous Weather Conditions In the event there are hazardous conditions at the time of your departure, we will reschedule your excursion to a new date and time. Payment Information All transactions are secure and encrypted. Gratuity Pricing includes 18% gratuity for your captain and crew. Review of Cancellation Policy I reviewed my booking times, dates, and Kapenas cancellation policy prior to submitting payment. Refund & Fees Named tropical storms ALL refunds incur a 10% processing fee plus a merchant fee Credit cards are accepted for all payments; however, each transaction will incur an additional 3% transaction fee. Shipboard Rules & Regulations 2023 Season Policy While at sea, the captain is the sole authority aboard…At sea leadership is very important for the comfort of passengers and the safe running of a vessel while at sea. Social input is always welcome. The captain will be in command at all times of the vessel. What the captain recommends, happens. We want you to enjoy your voyage. Restricted Items What Not to Bring and Not allowed on board: Illegal substances (non prescription drugs or illicit drugs, medical or recreational marijuana (Even of legal-not legal on the high seas), or weapons of any kind are to be brought aboard the boat. Violators will be returned to the dock immediately and the trip cancelled without refund. Change Policy One schedule date/time change is available at no charge. Additional schedule changes will be assessed a $150 change fee per change of departure day, time, vessel or port. Cancellation Policy Day of sailing 25% refundable, within three days of sailing 35% of deposit is refundable. Within 4-14 days of sailing 50% refundable, within 21 days of sailing 75% refundable, within 30 days of sailing 100% refundable. Cancel Charges All cancellations have a $75 admin fee if paid by credit card and credit card merchant fees can’t be refunded, typically 3.25%. If an event has been booked, vessel taken out of service for your event with crew assigned a minimum cancel charge for any reason (except for captain’s weather postpone) will incur a $275 cancel charge (Waived if your date / time changes to a date in the future within 365 days from your original booking date) Checks There will be a $25.00 service charge for any checks returned by the bank. If returned for NSF, you expressly authorize your account to be electronically debited for the check + fees and the use of your check for payment is your acknowledgement and acceptance of this policy and its terms and conditions. WEATHER POLICY We will do a final weather check with you 72 hours prior to departure. Most all people ask about weather—we get a good read on those 4-5 days prior to your departure and stay in close touch with you in case we need to mutually amend a date or time to allow for mother-nature. Rain is not a problem, heavy wind and or sea conditions could be—we want you to remember the event not the weather so we are careful to make sure that all systems are go about a week before departure, so you have the best at sea event as possible. Your safety and enjoyment at sea is our prime area of focus and responsibility. Should poor weather be forecasted or occur during your charter period, the captain reserves the right to cancel and/or postpone a sailing for the safety of the passengers and crew. Deposits are 100% refundable in this instance. If the charter has commenced and poor weather eventually rolls in, a mutually acceptable pro rated cost adjustment share of the total fee will be charged, with a minimum fee of $275. Kapenas reserves the right to amend, alter or delete these terms at any time. Any dispute resolution shall be through binding arbitration in Broward County, FL, with any and all court, arbitration or attorney fees to be paid by the party for whom enforcement is sought. What are the laws of spreading ashes? Kapenas adheres to all regulations set forth by the EPA as well as the State. Under the permit by the EPA: Cremated remains shall be buried in or on ocean waters of any depth provided that such burial takes place at least three nautical miles from land. What are the EPA Regulations? Scattered cremated remains are scattered in accordance with a general permit set forth by the EPA under Marine Protection, Research and Sanctuaries Act (MPRSA), Required EPA Paperwork Filing - US Code (40CFR229.1). Kapenas files these forms within 30 days of the service. Is it safe for the environment to scatter cremated remains? Yes. We ensure ashes are released in an ethical, respectful, and environmentally safe manner. How long is a group attended burial at sea service? Our service last about 90 minutes to 2-hours from Port to Port. If you would like extra time with your family, we can arrange for a fee. Do you co-mingle ashes? No. The remains of your loved one are not commingled with other clients. We take pride in giving your loved one a dignified and beautiful final farewell. How are the cremains scattered in the ocean? Our method of scattering cremated remain eliminates the error of having ashes in the wind, coming back at you. Using a basket of banana leaves and rose petals, we will instruct you how to lower the basket it into the water. This is beautiful, ceremonial way of spreading ashes and saying goodbye to your loved one. How do I book an Unattended Scattering at sea? Our online ordering system is 100% secure and encrypted, only takes a few minutes. Are burial at sea ceremonies child-friendly? It is our priority to ensure the safety of all our guest including children of all ages. Is sending cremains in the USPS mail reliable? In our experience, the USPS is very reliable in their express service specifically for cremains (ashes). If you are local in the Miami-Dade, Broward County, or Palm Beach County, please call us to arrange a free pickup by one of our Captains. What should I bring to a burial at sea? Just the urn of ashes. What if I get sea sick? We offer unattended ceremonies that take the worrying out of bad weather and sea sickness. Simply provide us the remains of your loved one and will provide an honorable service with documentation via a micro video and video so you can watch from the comfort of your own home. Do you offer unattended scatterings? Absolutely, we offer unattended sea burials with latitude and longitude coordinates along with video as we scatter the ashes at sea. You may also provide us with a prayer or note that our captain can read off during the ceremony. Flowers and wreaths are also available. Just because you can’t make be there, it doesn’t mean we don’t make it beautiful and dignified. Do you offer group scatterings? We cater to intimate groups, up to 12 persons. Each boat comes with bathroom, water, and a USCG captain and mate. What is the standard tip for your service? Our captain and crew work extremely hard before, during, and after your trip to ensure your short time with us exceeds your expectations. It is our duty to provide a safe and dignified trip for everyone on board. A standard tip is included. Where do we mail the remains? You may mail the cremated ashes directly to us for unattended ceremonies or bring them with you for your attended ceremony. We also offer pickup services to those within our service areas. How do I get my loved one’s ashes to Kapenas? You may use USPS Express Mail, with your precious cargo, which often arrives in one-day. USPS even provides you with packaging materials. Once we have the ashes in our possession, we will provide you with a digital photo and we will schedule the ceremony. When will the ceremonies be performed? Upon receiving the cremated remains, we do all scatterings within 14 business days. For expedited service, specific dates time, locations are available. Will there be proof of scatterings? Your captain will fill out our certificate of scattering service that includes name of deceased, latitude and longitude coordinates and date along with their signature. You may upgrade to full video of the ceremony as well. What is the process of scattering the ashes? Whether your choose an unattended or attended ceremony we go offshore about 3 miles. We highly recommend our basket ceremony as it a beautiful way to say your final goodbyes. Upon releasing your loved ones remains into the water, we circle them up to 5 times. The entire ceremony takes about 90 minutes to two hours from start to finish. Can I bring my own flowers or wreath? Absolutely. Bring as many flowers, rose petals and wreath as you would like. Wreaths and leis must be made with biodegradable material. We include two-dozen roses with your basket ceremony; however more is always welcomed. We can even pre-arrange to pick up your flowers per your request. What is your policy on cancellations? All cancellations must be made at least 45 days in advance. Do you consider conservation? Our company is focused on the conservation of our South Florida waterways and only uses water-safe, biodegradable, organic products such as natural wreaths and fresh flowers.
